English Language Requirements for Student Visa Applications(31-08-2009)

As a result of a recent court decision, the IELTS test for student visa applications can be done after the date of application but before date of decision.

The Full Court's decision concerned the English language proficiency requirement set out in Item 5A404 of Schedule 5A to the Migration Regulations, applicable to certain Student visa applications. At issue was the period in which Student visa applicants must sit a successful IELTS test.

The Court noted that the language of the phrase was intended to ensure the recency or currency of an IELTS test result so that decision makers could be satisfied of the language proficiency of Student visa applicants.

In the case that was appealed and lost by the Minister, the client did not achieve the necessary IELTS test scores until after he had lodged an application for MRT review of the Department's Student visa refusal decision.

Expansion of the number of Confirmation of Enrolments

The department is making changes to its systems that will expand the number of Confirmation of Enrolments (CoEs) that are able to be attached to a student visa application.

Currently, departmental systems are limited to attaching three CoEs to a student's visa application.  For applications lodged on or after 26 October 2008, the systems will be able to process up to nine CoEs per visa application.

What are the advantages of the change?
This change provides more clients with the opportunity to lodge applications electronically through eVisa. Clients and other users of the department’s eVisa system, will notice a slight change in the way eCoEs are entered on eVisa to reflect this expanded functionality.

When and how will the change be applied?
The change will affect applications lodged on or after 26 October 2008.  The change will take place in two stages.

In the first stage, implemented on 26 October 2008, all onshore applications and those lodged offshore through the department’s eVisa system will be expanded to allow up to nine eCoEs.

In November/December, offshore applications lodged manually at an office of the department will be updated to allow transmission to the deparment’s systems in Australia of up to nine eCoEs.
